From 2020 to present day, the survey process has seen many changes – some temporary and some permanent. Survey policy, along with enforcement protocol, adapted during the COVID-19 pandemic, and CMS is now establishing new expectations for survey agencies and providers as we all begin to turn our eye toward emerging from the public health emergency.

This summer, CMS announced implementation of major changes to survey and enforcement. The changes will be effective in less than two months – October 24. NOW is the time to become equipped with the knowledge you and your staff will need to be prepared for a new post-Oct 24 survey world, with new RoP Phase II and III implementation.

WHCA/WiCAL will be hosting three sessions – in Eau Claire, Appleton, and Milwaukee – to review state and national survey data and statistics, identify emerging trends, and focus on quality advancement given these significant changes to the survey landscape. We will also discuss ways to prepare for a “new normal” of the survey process, with an understanding that the survey process will continue to evolve. Presenters will also discuss the future of CMS and DHS survey/enforcement policy with new Phase II and III changes, as well as the prospect of a minimum staffing requirement and how that could affect survey.

At the completion of this session, participants should be able to:

  • Review survey, enforcement, and review/appeal timelines
  • Examine current survey activity, recent survey data, including how survey and enforcement has changed during the pandemic
  • Discuss processes for quality improvement and favorable survey outcomes
  • Review national and state policy developments and advocacy efforts.

Brian Purtell, J.D., WHCA/WiCAL Legal and Regulatory Advisor

Jena Jackson, MSM, RN, NHA, WHCA/WiCAL Director of Quality Advancement and Education
